General Terms and Conditions of Sale – MiaouTable

These General Terms and Conditions of Sale (hereinafter "GTC") are offered by MiaouTable, operating under the trade name MiaouTable, whose full legal information can be found in the Legal Notice of the website https://www.miaoutable.com.

Article 1 – Definitions

  • Site: the website https://www.miaoutable.com and all its pages.
  • Products: all products offered for sale on the Site.
  • Seller: MiaouTable.
  • Customer: any person making a purchase on the Site.
  • Consumer: any natural person acting for non-professional purposes.

The Customer acknowledges having read these GTC and accepts them without reservation before placing any order.

Article 2 – Purpose and Scope

These GTC govern all orders placed on the Site. They are applicable to the exclusion of any other document.

MiaouTable reserves the right to modify the GTC at any time. The applicable GTC are those in force on the date of the order.

Sales areas: Metropolitan France, Belgium, and Luxembourg.

Article 3 – Customer Service

All inquiries must include the first name, last name, and order number.

Article 4 – Orders

The Products offered are those listed on the Site, subject to stock availability.

Photographs are non-contractual.

The order is validated when the Customer clicks on "Finalize my order," accepts the GTC, and proceeds with payment.

Article 5 – Prices and Payment

Prices are indicated in euros, all taxes included (TTC), excluding delivery costs.

Delivery fees:

  • Standard delivery: €4.90
  • Free delivery from €50 purchase

Accepted payment methods are: credit card, Apple Pay, PayPal, and other methods offered via Shopify Payments.

Payment is secure. MiaouTable never has access to the Customer's banking data.

Article 6 – Delivery

Delivery times: Orders are generally delivered within 12 to 24 business days from the validation of the order.

These times are indicative and may vary during peak periods or exceptional circumstances.

Delivery areas: Metropolitan France, Belgium, and Luxembourg.

A tracking number is sent by e-mail upon shipment of the package.

MiaouTable cannot be held responsible for a delay attributable to the carrier or a case of force majeure.

Article 7 – Right of Withdrawal

In accordance with European consumer protection legislation, the Consumer Customer has a period of 30 days from receipt of the product to exercise their right of withdrawal, without having to provide reasons or pay penalties.

Return conditions:

  • Unused product, in its original packaging
  • Accompanied by the invoice or proof of purchase
  • Return to be made within 30 days of receipt

Procedure:

  1. Contact us at contact@miaoutable.com stating your order number
  2. We will provide you with the return address
  3. You return the product at your expense (unless the product is defective)
  4. We will process the refund within 14 days after receipt and verification of the return

Return shipping costs remain at the Customer's expense, except in the case of a defective product or an error on our part.

The refund is made via the initial payment method within a maximum of 14 days after receipt of the compliant return.

Note: The minimum legal withdrawal period in the European Union is 14 days. MiaouTable offers an extended period of 30 days for your satisfaction.

Article 8 – Legal Guarantees

The Products benefit from the following legal guarantees:

In France:

  • Legal guarantee of conformity (articles L217-4 et seq. of the Consumer Code)
  • Guarantee against hidden defects (articles 1641 et seq. of the Civil Code)

In Belgium and Luxembourg:

  • Legal guarantee of conformity according to applicable European directives
  • Guarantee period: 2 years from delivery

In the event of a lack of conformity, the Customer may request repair, replacement or, failing that, a reduction in price or cancellation of the contract.

Article 9 – Liability

MiaouTable cannot be held responsible for indirect damages resulting from the use of the Products.

MiaouTable's liability is limited to the amount of the order.

Article 10 – Force Majeure

MiaouTable's liability cannot be invoked in the event of force majeure as defined by Article 1218 of the Civil Code or by the legal provisions applicable in the Customer's country.

Article 11 – Intellectual Property

All elements of the Site (texts, images, logos, videos, graphics) are protected by intellectual property law. Any reproduction, representation, or use is strictly prohibited without prior written authorization from MiaouTable.

Article 12 – Personal Data

Personal data is processed in accordance with the General Data Protection Regulation (GDPR). The Customer has a right of access, rectification, deletion, portability, and opposition by writing to contact@miaoutable.com.

Article 13 – Applicable Law and Mediation

Applicable law:

  • For customers in France: French law
  • For customers in Belgium: Belgian law
  • For customers in Luxembourg: Luxembourg law

Dispute mediation:

In accordance with Articles L612-1 et seq. of the French Consumer Code and European directives, the consumer Customer may freely have recourse to a consumer mediator in the event of a dispute.

In case of dispute, an amicable solution will be sought before any legal action.
